Canadians Involved in Car Accidents in Massachusetts

Home of the famous Red Sox, New England Patriots, and the Bruins, Massachusetts is one of the major northern states that sees a plethora of snowbirds who head south for the winter.  Yes snowbirds share a lot of New England pride no matter where they flock to.

Unfortunately, snowbirds get into accidents. Massachusetts has some complex personal Injury laws which knowledgeable lawyers need to address.

For example if someone is involved in a personal injury accident (such as a car, motorcycle, bicycle or pedestrian accident) they have three-years from the date of the accident to file a lawsuit. It is also a “modified comparative no-fault” state.  You are only allowed to proceed with a claim for financial recovery against the person who injured if you are less then 50 percent responsible for the accident, incurred at least $2,000+ in medical expenses; and/or you suffered a permanent and serious disfigurement, or a fractured bone, or a substantial loss of hearing or loss of sight.  Wow! Confusing! And what a mouthful!

Car insurers also provide Personal Injury Protection.  The minimum benefit coverage for injured parties is up $8,000 which includes expenses for:

  • medical bills;
  • 75% of lost income due to an inability to work, and,
  • “replacement services” (for someone to take care of household chores that you’re unable to perform because of the accident

Please note all insurance policies can be enhanced.  You just have to pay a higher premium.

Minimum car insurance -In order to legally drive a motor vehicle in Massachusetts, owners must carry a minimum of:

  1. $20,000 liability coverage;
  2. $40,000 total liability coverage per accident, regardless of how many people are injured;
  3. $5,000 liability coverage for property damage;
  4. $8,000 in no-fault (personal injury protection) coverage; and,
  5. uninsured motorist coverage for bodily injury of $20,000 per person/$40,000 total per accident.

Since 1981, Snowbird Accidents has been helping seriously injured motorists receive the medical treatment and compensation they deserve.  We understand it is not just the injured party that may require assistance, but often their loved ones that face significant challenges in helping the accident victim.
